The General Terms and Conditions of Sale and Delivery apply.

The following General Terms and Conditions apply to all deliveries, services and offers. Any deciating terms and conditions of the customer that we do not expressly acknowledge in writing are not binding on us, even if we do not expressly object to them.

Warranty

In addition to the statutory provisions, the following conditions apply to the warranty: If the product is defect, you can request that the defect be remedied or that a defect-free product be delivered (subsequent performance). We may refuse the type of subsequent performce you have chosen if it would only be possible at disproportionately high costs.

In this case, your claim is limited to the other form of subsequent performance. We may also refuse this due to diproportionately high costs. If we deliver a defect-free product for the purpose of subsequent performance, you have to return the defective product and pay compensation for the value of the product used to date.

If subsequent performance fails or if we refuse both types of subsequent performance, you can withdraw from the contract or reduce the purchase price. If you decide to withdraw from the contract, you will receive a refund of the purchase price, less the value compensation for the previous use of the defective goods. Please understand that we can only accept asserted warranty claims if you provide us with proof of when you purchased the item from us, for example, by presenting the payment receipt.

We can not accept any liability for damage caused by improper use or handling of the purchased item. If the goods are ready for delivery and delivery or aaceptance is delayed for reasons beyond our control, the risk shall pass to the purchaser upon receipt notification of readiness for shipment.

Note on the behavior of wood:

The shrinkage of wood caused by drying processes and the associated formation of cracks, gaps or fissures is unavoidable in the natural product wood and can not be recognized as a defect.

Retention of title

All delivered goods remain our property until all claims, including any outstanding balances, to which we are entitled, regardless of the legal basis, have been settled. This also applies if payments are made on specifically designated claims. The extendet retention of title is deemed to have been agreed.

Place of performace / jurisdiction

These terms and conditions and the entire legal relationship between buyer and seller shall be governed by the laws of the Federal Republic of Germany. The place of performance and jurisdiction for disputes arising from this contract shall be the Amtsgericht Delbrück.

Final provisions

Should any provision of these Terms and Conditions or a condition within the framework of other agreements be or become invalid, this shall not affect the validity of all other provisions or agreements. No further agreements, amendments or ancillary agreements are deemed to have been made; verbal commitments must be confirmed in writing.
